Welcome to the Team Connect – EEA mobile application (the “App”). The App is owned and operated by Earthmoving Equipment Australia Pty Ltd (“EEA,” “we,” “us,” or “our”), located at 204 Power Street, Glendenning, New South Wales, Australia 2761. Furthermoore, The Team Connect app is an internal tool provided solely for employees of EEA within Australia. By registering for and using this app, you agree to maintain the confidentiality of the data accessible through Salesforce integration and adhere to company policies governing data usage. Unauthorized access, distribution, or use of app data is strictly prohibited. Users are required to follow all security measures outlined by the company, including account approval processes. Non-compliance with these terms may result in disciplinary action, including termination of access or employment, and may involve legal consequences.By downloading, installing, or using the App, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the App.

  1. Acceptance of Terms By accessing or using the App, you confirm that you are at least 18 years old or have reached the legal age of majority in your jurisdiction. You also confirm that you have the authority to accept these Terms on behalf of yourself or any entity you represent.
  2. License to Use the App We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose of communicating with your customers via SMS and email with links to recorded videos. You agree not to:
  • Modify, copy, or distribute the App’s content.
  • Reverse-engineer, decompile, or disassemble the App.
  • Use the App for illegal or unauthorized purposes.
  1. User Responsibilities You are responsible for ensuring the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate and complete information when using the App and to update your information as necessary.
  2. Communication Features The App enables communication with customers via SMS and email, including links to recorded videos. You are solely responsible for the content of these communications and ensuring compliance with applicable laws, including but not limited to privacy and anti-spam regulations.

  4. Intellectual Property All intellectual property rights in the App, including but not limited to its content, design, and functionality, are owned by EEA or its licensors. You may not use our intellectual property without our prior written consent.
  5. Third-Party Services The App may integrate or link to third-party services. We are not responsible for the content, functionality, or practices of these services. Your use of third-party services is subject to their respective terms and conditions.
  6. Limitation of Liability To the maximum extent permitted by law, EEA is not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the App. This includes but is not limited to damages for loss of profits, data, or goodwill.
  7. Termination We reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including breach of these Terms.
  8. Changes to Terms We may update these Terms from time to time. Any changes will be effective immediately upon posting on our website or within the App settings. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.
  9. Governing Law These Terms are governed by the laws of New South Wales, Australia, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the courts of New South Wales.
